These Terms of Service ("Terms") govern your access to and use of Atmos — the macOS application and related website at getatmos.app (collectively, the "Service"), operated by Atmos ("we", "us", or "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use Atmos. By using the Service you represent that you meet this requirement and that all information you provide is accurate.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at
support@getatmos.app if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Subscription and Billing
Atmos is offered on a subscription basis. A 7-day free trial is available for new accounts. After the trial ends your subscription will automatically renew at the applicable rate unless cancelled before the renewal date.
All fees are charged in US dollars and are non-refundable except as required by applicable law or as expressly stated in our refund policy. We may change subscription pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
You may cancel your subscription at any time from your account page. Cancellation takes effect at the end of the current billing period; you will retain access until then.
4. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service to develop a competing product.
- Attempt to gain unauthorised access to our systems or other users' accounts.
- Use automated means (bots, scrapers) to access the Service.
- Violate any applicable law or regulation while using the Service.
- Misrepresent your identity or provide false information.
5. Intellectual Property
All content, design, code, trademarks, and other materials in the Service are owned by or licensed to Atmos. Nothing in these Terms grants you any ownership rights. You are granted a limited, non-exclusive, non-transferable licence to use the macOS application for personal, non-commercial purposes during an active subscription.
6. Third-Party Services
The Service integrates with third-party providers including payment processors and infrastructure services. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the practices of third-party services.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
8. Limitation of Liability
To the maximum extent permitted by law, Atmos shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Atmos and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
10. Termination
We may suspend or terminate your access to the Service at our discretion, with or without notice, for any violation of these Terms. Upon termination your licence to use the application ends immediately. Provisions that by their nature should survive termination (including liability limitations and ownership clauses) will do so.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law provisions. Any disputes shall be resolved exclusively in the courts located in Vancouver, British Columbia, Canada.
